r 4 t i RECEIVED MAY 1 1 201? rio.05 -11-201 7-01 KAY BROWN COUNTY CLERK ORDER OF THE CHRISTIAN COUNTY COMMISSION OZARK, MISSOURI DATE ISSUED: Mayll,2017 SUBJECT: Submission of a proposal to the qualified voters of Christian County to discontinue application and collection of the local sales tax on the titling of motor vehicles, trailers, boats, and outboard motors that were purchased from a source other than a licensed Missouri dealer WHEREAS, the Christian County Commission on this 11 day of May, 2017, at a meeting duly called, noticed, and held, considers the matter of submitting a proposal to the qualified voters of Christian County for their approval or disapproval at the General Election called to be held on August 8, 2017 the question of whether to discontinue application and collection of the local sales tax on the titling of motor vehicles, trailers, boats, and outboard motors that were purchased from a source other than a licensed Missouri dealer; and WHEREAS, the County has not previously approved and Imposed a local use tax under Section 144.757, RSMo; and WHEREAS, the County is required under the provisions of Section 32.087, RSMo. to submit to the qualified voters of the County the question of continuing or repeallng the application of the local sales tax to the tltllng of motor vehides, trailers, boats, and outboard motors that were purchased from a source other than a licensed Missouri dealer; and - WHEREAS, the County Is required to submit the question to its voters no later than the General Election in November, 2018, or collection of the aforesaid local sales tax will be discontinued; and WHEREAS, the continuation of the local sales tax on purchases of motor vehicles, trailer, boats, and outboard motors that were purchased from sources other than a licensed Missouri dealer cannot occur until it Is submitted to the qualified voters of Christian County, Missouri, and approved by a majority of the qualified voters voting thereon; and 1 1 WHEREAS, the maintaining of a local sales tax will continue the policy of eliminating an advantage for out of state dealerships over local dealerships. NOW, THEREFORE, on this 11th day of May, 2017, on motion duly made and seconded, the question was called on whether it would be appropriate to submit a proposition to the qualified voters of Christian County, Missouri at an election on August 8, 2017, whether to repeal application of the local sales tax to the titling of motor vehicles, trailers, boats, and outboard motors that are subject to state sales tax under Section 144.020, RSMo., and purchased from a source other than a licensed Missouri dealer, and Commissioner Phillips voted "yes", Commissioner Bilyeu voted "yes", and Presiding Commissioner Weter voted "yes". Therefore, in accordance with said Motion, IT IS HEREBY ORDERED this proposition shall be submitted to the qualified voters of Christian County, Missouri, for their approval, as required by the provisions of Section 32.087, RSMo., at the General Election to be held in Christian County, Missouri on Tuesday, August 8, 2017. IT IS FURTHER ORDERED, the County Clerk shall proceed to place the proposition on the ballot at said election which ballot shall be in substantially the following form: OFFICIAL BALLOT ELECTION - TUESDAY, AUGUST 8, 2017 Shall the County of Christian discontinue applying and collecting the local sales tax on the titling of motor vehicles, trailers, boats, and outboard motors that were purchased from a source other than a licensed Missouri dealer? Approval of this measure will result in a reduction of local revenue to provide for vital services for the County of Christian and it will place Missouri dealers of motor vehicles, trailers, boats, and outboard motors at a competitive disadvantage to non-Missouri dealers of motor vehicles, trailers, boats, and outboard motors. IT IS FURTHER ORDERED, if the ballot question set forth above receives a majority of the votes cast in favor of the proposal, the local sales tax shall cease to apply to the titling of motor vehicles, trailers, boats, and outboard motors that were purchased form a source other than a Missouri dealer. The effective date of the cessation shall be the first day of the second calendar quarter after the election. If a majority of the votes cast are opposed to the ballot question then the local sales tax shall continue to apply to the titling of motor vehicles, trailers, boats, and outboard motors that were purchased form a source other than a licensed Missouri dealer. IT IS FURTHER ORDERED within ten (10) days after the approval or disapproval of the proposition by the qualified voters of the County of Christian, Missouri, the County Clerk shall forward to the Director of Revenue of the State of Missouri by United States registered mail or certified mail, a certified copy of this Order together with certifications of the election returns and any other necessary documentation. IT IS FURTHER ORDERED, that this Order shall be effective upon passage by the Christian County Commission, and a copy of this Order shall be filed in the Office of the Clerk before 5:00 p.m. this date.
