SUBJECT:                 Delaware Town Village Question of Incorporation

        WIIEREAS, on August 25,2008, a petition for incorporation of Delaware Town Village
was presented to the County Clerk signed by certain voters residing within the legally described
metes and bounds of the proposed village pursuant to Section 72.080, RSMo.; and

        WHEREAS, the County Clerk has certified that the eighteen (18) signors of the Petition
calling for a special election to incorporate an area to be known as Delaware Town Village are
voters in the area proposed to be incorporated which are equal to or greater than 15% ofthe votes
cast in the last gubernatorial election in the area proposed to be incorporated; and

        WHEREAS, the Petition for the incorporation of Delaware Town Village has been
submitted to the County Commission for a decision.

        NOW, THEREFORE, on this @614 day of January, 2009, at a duly called meeting of
the Christian County Commission, after public notice, and in open session, upon motion duly
made by Commissioner F); 91 8ar#e-(t , seconded by Commissioner 76 va k,44- , and
presiding Commissioner Grubaugh voting in favor, the Christian County Commission did vote to
call a special election on April 7,2009, to put to the voters the proposition of whether or not to
incorporate the area legally described within the Petition as the Village of Delaware Town
pursuant to Section 72.080, RSMo.

        IT IS FURTHER ORDERED the incorporation of Delaware Town Village shall not be
effective unless approved by a majority of the votes cast on this proposition by eligible voters in
the area proposed to be incorporated in accordance with Section 72.080, RSMo.

        IT IS FURTHER ORDERED the Christian County Clerk shall forthwith cause this
proposition to be submitted to eligible voters at the April 7,2009, election in substantially the
following form:
