Plaintiffs Petition for Removal of Candidate being heard this Court orders the following: (1.)

Plaintiffis peimitted to withdraw his candidacy for Associate Circuit Judge, Division 2 of

Christian County; and (2) Defendant, in her official capacity only, is to remove Plaintiffs name

from the ballot for the primary election on August 5,2014.

                     PETITION FOR REMOVAL OF CANDIDATE

         COMES NOW Plaintiff, Kevin Elmer, pro se, and for his petition for removal

 states as follows:

         1. Plaintiffis currently a candidate for the office ofAssociate Circuit Judge,

 Division 2 in the primary election scheduled for August 5,2014.

        2. Defendant is the Christian County Clerk and election authority for

 Christian County.

        3. Plaintiffdesires to withdraw his candidacy immediately.

        4. Pursuant to Sect. 115.359 RSMo. Plaintiffis.precluded from withdrawing

without an Order of this court, however, is eligible to withdraw by court Order because

the primary election is more than six weeks away at this time. (115.359 RSMO, para 2).

        5. Plaintiffbelieves that there will be no additional costs to the County ifhe

withdraws immediately.

       WHEREFORE, Plaintiffprays the court for its Order (1.) Allowing Plaintiff to

withdraw his candidacy for Associate Circuit Judge, Division 2 of Christian County; (2.)

                         .

ordering Defendant, in her official capacity only, to remove his name from the ballot for

the primary election on August 5,2014; and (3.) for such other relief as is just.
