          ORDER ALLOWING CANDIDATE PLETCHER ROGERS TO WITHDRAW

        The Court has received Petition for Order Allowing Candidate

Pletcher Rogers to withdraw pursuant to Section 115.359 RSMo. and

the Consent of the Defendant, Christian County Clerk, Kay Brown, to

the entry of said order along with her Entry of Appearance and

Waiver of Service.

        The Court has considered the Petition and Section 115.359.2

which states that the court "shall" freely give authority to

withdraw to the candidate except for good cause shown by the

election authority in opposition thereto.                              There is no opposition

to the Petition for Order Allowing Candidate Pletcher Rogers to

withdraw and, therefore, it is

        ORDERED, ADJUDGED AND DECREED that candidate Pletcher Rogers,

whose name appears as a candidate for the office of mayor of the

City of Sparta be removed from the April 5, 2005, ballot and

election date.            Defendant Christian County Clerk, Kay Brown, is

hereby ordered to comply with this Order by removing Pletcher

Rogers' name from the said ballot priorego-Prining thereof.

               ORDER ALLOWING CANDIDATE TO WITHDRAW; ENTRY OF
       APPEARANCE AND WAIVER OF SERVICE OF SUMMONS AND PETITION

        COMES NOW, Kay Brown, the County Clerk of Christian County,

Missouri and for this consent states to the Court as follows:

        1. That the undersigned is the County Clerk for the County

of Christian, State of Missouri, and is, therefore, the election

official for Christian County.

        2.      The undersigned has received a Petition for Order

Allowing Candidate to Withdraw in the above styled cause wherein

candidate, Pletcher Rogers for the office of City Mayor of Sparta,

Missouri has requested this Courtls order to withdraw his

candidacy.

        3. The undersigned does hereby consent to the entry of said

order, does hereby voluntarily enter her appearance in this matter

and does waive service of process including summons and Petition.

        4.      The undersigned does, further, consent to the entry of-
